SafeElectricity.org is a product and service of the Energy Education Council (“EEC”), a 501(c) 3 non-profit organization established in 1952 that provides life-saving, energy-saving, and cost-saving information and resources to its members and consumers.
Safe Electricity® is an award-winning, multi-media public awareness program of EEC. Since the program’s creation in 2001, Safe Electricity® has been providing information to consumers and helping complement the safety education activities of utilities and educators. The program provides life-saving information through its comprehensive website, radio and television public service announcements, videos, and more. Safe Electricity® has received national recognition for the quality and scope of its programs and services.
All users of this site agree to be bound by the following terms and conditions of use.
Intellectual Property and Proprietary Rights: All text, graphic user interfaces, visual interfaces, photographs, trademarks, logos, sounds, artwork, and computer code (collectively, “Content”), including but not limited to the design, structure, selection, coordination, expression, “look and feel,” and arrangement of such Content, contained on this site is owned, controlled, or licensed by or to EEC or SafeElectricity.org and is protected by trade dress, copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws. Except as expressly provided in this Agreement, no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed in any way (including “mirroring”) to any other computer, server, website, or another medium for publication or distribution or for any commercial enterprise, without EEC’s express prior written consent.
Member Copyright License: EEC grants password-protected access to and use of EEC’s proprietary and copyright-protected materials from EEC and the Safe Electricity® program on the Members Only website as a benefit of membership. The materials include a wide assortment of educational publications and communication tools, timely news releases, professionally designed media for consumers, a photo library of more than 1,500 images, television and radio PSAs, and much more.
The content of the Member site is intended for member use only and protected under Copyright and Trademark law. EEC and SafeElectricity.org grant members a limited, revocable, nonexclusive license to download or print material from this site for member’s information or use, but otherwise expressly prohibits the reproduction, selling, licensing, publishing, distribution, display, performance, transferring, or modification of any portion of its materials for any purpose other than educating its members or member’s consumers, without prior written consent. Users agree not to copy, use, or otherwise infringe upon or to dilute the trademarks or service marks of EEC or SafeElectricty.org beyond the extent of their license, and agree not to alter or remove any trademark, copyright, or other notice from any copies of the content on this site. Any party who seeks an expanded license or use of the materials provided on this site should contact the administrator of this site directly.
Users additionally grant a royalty-free, perpetual, irrevocable, nonexclusive, transferable, and sublicensable license to EEC and SafeElectricity.org to copy, modify, display, distribute, perform, create derivative works from, store, and otherwise use any ad, content, photos, data, or other materials either submitted to the site in any form, media, software, or technology of any kind now existing or developed in the future, or from which derivative works have been created by its Members using EEC or SafeElectricity.org copyright protected or proprietary materials.
Members must protect EEC’s and SafeElectricity.org’s information from misappropriation by employing reasonable efforts to monitor and prevent the use of any “deep-link,” “page-scraping,” “robot,” “spider,” or other automated device, program, algorithm, or methodology, or any similar or equivalent manual process to access, acquire, copy, or monitor any portion of EEC’s Members Only website. Members are entirely responsible for maintaining the confidentiality of their account information, including their password and for any and all activity that occurs under their account. Participants agree to notify EEC immediately of any unauthorized use of their account or password, or any other breach of security.
Be advised that EEC will also promptly process and investigate any notice of an alleged infringement of its own or another parties’ intellectual property. EEC does not endorse, sponsor, or guarantee linked websites and is not responsible in any way for any content, information, products, advice, or services made available through linked websites. Users who click on links to third-party sites should be aware they are leaving an EEC website and shall be subject to the privacy policy and terms of service of any third-party website the user selects. Website operators who wish to link to this site may only link to the home page. EEC reserves the right, however, to reject or terminate any links to the content of this site.
User Representations and Indemnifications: A user shall not post any content or material on this website unless the user first represents and warrants (i) the submitted materials do not and/or will not violate any applicable federal, state, or local law or regulation; (ii) the materials submitted do not and/or will not infringe or misappropriate any copyright, trademark, trade secret, patent, or any other intellectual property right of any third party, including the rights of privacy or publicity, and (iii) the user has the necessary authority, rights, and permission to post the material submitted.
If a user posts any material in violation of any of the rules identified above, the user agrees to release, defend, indemnify, and hold EEC, its respective officers, directors, employees, agents, affiliates, associates and/or contractors harmless from and against any and all claims, costs, demands, or expenses, and/or consequential damages, including attorneys’ fees, arising from any distribution, publication, deletion, movement, editing, or other use of the materials provided.
Prohibited Activities: A user may not post, e-mail, link, or otherwise make available any material that: (1) is unlawful, harmful, threatening, abusive, harassing, defamatory, pornographic, and/or invasive of another’s privacy; (2) is false, deceptive, misleading, deceitful, and/or that impersonates any person or entity or falsely misrepresents an affiliation with a person or entity; (3) is patently offensive in that it promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability; (4) involves the furtherance or transmission of “junk mail” or unsolicited mass mailing or “spam”; (5) promotes, displays or promulgates pornographic or sexually explicit material of any kind; (6) constitutes abusive, threatening, harassing, or “stalking” communications; (7) engages in commercial activities and/or sales beyond energy education without prior written consent; (8) includes a source code, file, program, or software designed to interrupt, destroy, limit, copy, or control this sites platform, and/or that attempts to collect personal identifying information and data about users through the use of any robot, spider, crawler, data mining tools, or other automatic device, and/or a manual process; (9) decompiles, reverse engineers, disassembles, or otherwise attempts to obtain the source code for the Platform; or (10) imposes an unreasonable or disproportionately large load (flooding) on the site’s hardware and software infrastructure to effect the quality of quantity of material on the site.
Choice of Laws and Consent to Jurisdiction: These Terms of Service will be governed by and construed in accordance with the laws of the State of Illinois without regard to its conflicts of law provisions. You hereby agree that any cause of action you may have with respect to the Site must be exclusively filed in the federal or state courts located in Sangamon County, Illinois, within one (1) year after the cause of action arises or the cause is barred. You hereby consent to personal jurisdiction in the federal and state courts in Sangamon County, Illinois, and waive any objection based on forum non conveniens. As a condition of using this Site, you agree that all causes of action arising out of or connected with this Site shall be resolved individually, without resort to any form of class action.
Severability: If for any reason a court of competent jurisdiction finds any provision of these Terms of Service, or portion thereof, to be unenforceable, that provision of these Terms of Service will be enforced to the maximum extent permissible so as to affect the intent of the parties, and the remainder of these Terms of Service will continue in full force and effect. A failure by EEC to enforce any provision of these Terms of Service will not be deemed a waiver of future enforcement of any provision. These Terms of Service constitute the entire agreement between the parties. Neither this Terms of Service, nor any terms and conditions contained herein, shall be construed as creating a partnership, joint venture, or agency relationship or granting a franchise between the parties.
